PRIVACY AND DATA OWNERSHIP POLICY FOR MARKETING SERVICES

At BidReach LLC (“BidReach”, “We”, or “Us”), we strive to collect your personal information only when necessary, to process it in a transparent manner, and to protect it appropriately. This Privacy and Data Ownership Policy describes what information we collect, what we do with that information, and what you can do to learn more about personal information we may collect about you. It applies to the information collection and use practices of BidReach in connection with our products and services (“Services”).

Personal information we collect:

We collect the following categories of personal information:

  • Identifiers and contact information – This category includes your name, email address, street address, social media handles, and other information primarily used to contact you or to perform the Services.

  • Commercial information – This category includes information about your method of payment, such as a payment card. Note that payment card and other electronic transactions go through our vendor, so we never have the full card number or other sensitive financial information ourselves.

  • Bidder, Product, and Marketing Data. In order to perform the Services, BidReach employees or agents may access your own internal information about your bidders, products, and auctions, and the channels through which you advertise this information. This includes information regarding sales, products, and customers your CRM systems, social media handles and accounts, e-mail marketing services, bidder/auction management systems, and similar systems.

  • Network information – If you visit our website, we may collection information about your visit. This category includes your IP address, the browser type you use or similar system information, and the pages you view within the website.

Note that the Services are not directed to children, children do not typically participate in our customers’ auctions, and we do not knowingly collect information from children under 16. If you are a parent or guardian and believe that we have information about your child, please contact us to discuss the matter. Also note that we do not collect or process “sensitive” or “special category” personal information.

How do we collect personal information?

We collect personal information in the following ways:

  • Directly from you –

    • If you ask a question or make a request, you will need to provide sufficient contact information for us to respond.

    • If you transact business with us, you will need to provide sufficient information to enable the transaction.

  • Internally – Our records include the types of services we have provided to you, and when.

  • Passively through our website - When you visit our website, we collect information such as your computer’s IP address and browser information, the date and time of your visit to each page of our website, and time you spent on each page. Also, our site uses "cookies" to help personalize your online experience.

  • Through Access to Your Systems. As part of providing the Services, we may access your internal auction and customer management systems, and your social media accounts, directly, and may acquire or download information from these systems and accounts.

Why do we collect personal information?

We collect personal information for the following purposes:

  • To respond to your questions and requests;

  • To process transactions;

  • To provide the Services;

  • To improve the effectiveness of the Services; and

  • To protect our network, systems, and data, including personal information.

We will use your data only for these purposes, or as otherwise permitted by law, by this Privacy and Data Ownership Policy, or as described in any other written agreement we have with you (including our marketing services agreement).

Do we sell or share your personal information with third parties?

We do not sell your personal information. We will not disclose personal information to third parties except as described herein or in our marketing services contract. We will use the personal information we collect only to provide the Services to you, or as otherwise descried in this Privacy and Data Ownership policy or in the marketing services contract.

We share personal information (all categories mentioned above) with third parties that are integrated into our business operations. These third parties provide services in the following categories:

  • Cloud storage

  • Payment processing

  • Customer service / Help desk

  • Email campaign support

  • Subscription services support

  • Personalization and social media support

  • Website performance and error detection

To the extent that we disclose your data to third parties, their privacy policies should provide all necessary information about their processing of personal data.

If we are compelled by law to disclose personal information – for example, in response to a court subpoena – we will comply with the law.

Where do we store your data?

Your personal data that BidReach stores is located on the Amazon Web Services servers in Virginia, USA. We do not transfer your personal data outside the USA.

How long will we keep your data?

We will not keep your data longer than necessary. We will ordinarily delete your data within 90 days after the end of your marketing services agreement with us, unless retention is required by law or necessary for legal defense purposes.

A special note about data ownership:

At BidReach, we value the trust our clients place in us to support and enhance their marketing efforts. This Privacy and Data Ownership policy is part of our commitment to transparency and integrity. All data provided to BidReach by the client, as well as all data collected, generated, or derived in the course of providing marketing services for the client, shall be considered the exclusive property of the client. This includes, but is not limited to:

  • Customer contact lists and mailing lists

  • Website analytics and marketing performance data

  • Ad campaign results and metrics

  • Bidding and registration data obtained via marketing channels

  • Creative assets and marketing content developed specifically for the client

BidReach does not claim ownership of any client data. We also take the confidentiality and security of client data seriously. We implement reasonable administrative, technical, and physical safeguards to protect client data from unauthorized access, disclosure, or misuse.

What rights do you have in connection with your personal data?

Privacy laws in certain jurisdictions provide certain rights for individual consumers. Those rights may include, based on your geographic location, the following:

  • Right to Know – You may ask for details about the personal information we have collected about you.

  • Right of Access - You may ask to access the personal information we have collected about you.

  • Right to Correct – You may ask us to correct any inaccuracies in the personal information.

  • Right to Delete – You may ask us to delete or anonymize the personal information.

  • Right of Portability – You may ask us to provide a copy of the personal data that you have previously provided to us in a portable and readily usable format.

  • Right to Opt-out – You may ask us not to process your personal data for the purposes of targeted advertising or profiling. As stated above, we do not sell your personal information, and do not share it within the definition used in California law.

  • Right to Non-Discrimination – We will not discriminate against you for exercising these rights.

  • Right to Appeal – If the response to your request does not meet your needs and expectations, you may appeal the decision to our senior management.

You may exercise many of these rights, or any other right provided by applicable law regarding your data, by e-mailing us at info@bidreach.com. Note that if you wish to exercise your right to delete records of your visits to our website, you must also clear cookies from your browser.

Note also that we do not send to you direct marketing e-mails, so you would have no occasion to exercise a right to opt out of direct marketing e-mails.

We may, under applicable law, require additional proof of your identity. If you use an authorized agent, we may require the agent to submit proof that they are authorized to act on your behalf.

How will we notify you of changes in the Privacy and Data Ownership Policy?

We may update this Privacy and Data Ownership Policy from time to time, and we will always post the most up to date version on our website, www.bidreach.com. All changes are effective immediately upon posting.

Although this Privacy and Data Ownership Policy is generally applicable, we never want to lose business because you feel uncomfortable with some aspect of it. We want to work with you.
